Terminology

Understanding the different billing arrangements is crucial when hiring legal services:

  • Hourly Agreement: Charges are based on the time spent on your case, with no specified limit or cap.
  • Fixed Fee Arrangement: A set charge is determined for the entire case or specific parts of it, such as pre-suit negotiation, preparation of a motion to dismiss, or trial. This provides cost predictability.
  • Budget: A non-binding estimation of costs, often based on certain assumptions or parameters. If additional work is needed, the lawyer justifies the added costs and bills accordingly, sometimes with a modest reduction.

In a fixed fee paradigm, the attorney evaluates the claim or scope of work and charges the agreed-upon fee.
